2008/07- Madagascar Commercial Invoice Regulations

Madagascar’s customs authority has issued a circular outlining the mandatory information that must appear on commercial invoices attached to the Cargo Tracking Note (BSC) for customs clearance. Non-compliant commercial invoices will be rejected and will not be validated by the BSC/GasyNet Technical Centre.

It is brought to the attention of the public that in the context of commercial fraud prevention and detection, for assessment purposes and in accordance with current regulations, invoices attached to the Cargo Tracking Note (BSC) for customs clearance operations must include the following information:

  1. The name or company name and exact address of the seller (exporter).
  2. The name or company name, exact address and Tax Identification Number (TIN) of the buyer (importer).
  3. The date of issue and the sequential and continuous invoice number.
  4. The description of the goods or product enabling their immediate identification for customs purposes, particularly for tariff classification under the Harmonized System (HS).
  5. The brand, reference, origin and characteristics of the goods or product.
  6. The packaging (bulk, parcels, barrels, bales, etc.)
  7. The detailed quantity (bulk, in a parcel or package or bale, etc.), the unit price in legal tender currency, the total price of the goods sold.
  8. The total amount of the invoice (in figures and in words).
  9. The terms of sale (Incoterm).
  10. The method of payment.
  11. The signature of the seller (exporter).

Non-compliance with these provisions will result in the outright rejection of the invoices submitted and non-validation of the BSC at the BSC/GasyNet Technical Centre.

However, invoices that are formally acceptable will be analysed on their substance by the Administration for the determination of the final taxable value.
